Dialogue on the Fourteenth Amendment

The American Bar Association Dialogue program provides lawyers, judges and teachers with the resources they need to engage students and community members in a discussion of fundamental American legal principles and civic traditions. This Dialogue on the Fourteenth Amendment is composed of three parts:
Part 1: Equal Protection and Civil Rights – Participants discuss the equal protection clause of the 14th Amendment and consider how Congress, through federal legislation, has worked to help realize its constitutional promise.
Part 2: Incorporating the Bill of Rights examines the concept of incorporation. Using a case study of Gitlow v. New York, this section provides a guide to how courts have applied the Bill of Rights, selectively, to the states using the 14th Amendment.
Part 3: Ensuring Equality and Liberty explores how the 14th Amendment has been interpreted by courts to protect fundamental freedoms, including individuals’ right to marry.

Core Documents Collection – Documents and Debates 1865-2009

The Core Documents Collection – Documents and Debates is structured around a series of topics, each based on a question for debate. For each topic, there is a collection of documents that, together, form the basis of argument over that topic – from those who debated it at a given point in American history. Volume One covers 1865-2009.
The goal is to explore a series of critical moments in American history by asking questions for which there are not simple yes/no answers, but instead call for informed discussion and rational debate. The Documents and Debates readers also include appendices of additional documents, and together are a perfect fit for any American History survey course, including AP U.S. History.

The Role of the Judiciary

In this lesson, students learn about the judicial system, aka the judiciary. First, students read and discuss an article on the role, structure, and principles of the judiciary. Next, they participate in a Civil Conversation on the reading. In this structured discussion method, under the guidance of a facilitator (the teacher), participants are encouraged to engage intellectually with challenging materials.

The Constitutional Convention: Fine Tuning the Balance of Powers

History is the chronicle of choices made by actors/agents/protagonists in specific contexts. This simulation places students in the midst of the Constitutional Convention, after the Committee of Detail has submitted its draft for a new Constitution on August 6. With that draft’s concrete proposals on the floor, students will ponder questions such as: Is this the Constitution we want? Are the people adequately represented? Are the branches well structured? By engaging with these questions mid-stream, before the Convention reached its final conclusions, students will experience the Constitutional Convention as process, a supreme example of collective decision-making.

Civil Conversation: Immigration Enforcement Raids

Controversial legal and policy issues, as they are discussed in the public arena, often lead to polarization, not understanding. This Civil Conversation activity offers an alternative. In this structured discussion method, under the guidance of a facilitator, participants are encouraged to engage intellectually with challenging materials, gain insight about their own point of view, and strive for a shared understanding of issues. This lesson plan addresses the debate over the policies of the federal agency – Immigration and Customs Enforcement – that investigates and enforces the nation’s immigration laws.

A Lesson on Benjamin Franklin’s ‘Project for Moral Perfection’

This selection is taken from The Autobiography of Benjamin Franklin. This excerpt focuses on self-improvement, specifically the pursuit of “moral perfection” through carefully structured and documented practice. Through textual analysis and group discussion, students will reflect on their own personal value systems and articulate principles by which they choose to live. Common Core-aligned. Includes a model discussion.

A Lesson on Martin Luther King Jr.’s ‘I Have a Dream’ Speech

This lesson can be used during a unit on the Civil Rights Movement or in remembrance of the March on Washington or Martin Luther King Jr.’s Birthday holiday. Students will be able to: Analyze in detail how a complex primary source is structured, including how key sentences, paragraphs, and larger portions of the text contribute to the whole.
